Food Truck Permits & Health Codes: A Startup's Step-by-Step Guide

Ask any experienced operator what nearly derailed their launch and you'll hear the same answer: permits. The good news is that permitting is very manageable when you understand the steps and build your unit to code from day one. Here's the path.

1. Form your business and get licensed

Before anything truck-specific, set up the legal foundation:

  • Register your business entity (LLC, sole proprietorship, etc.)
  • Get your federal EIN and any required state tax IDs
  • Obtain a general business license in your operating city/county
  • Apply for a seller's/resale permit if your state requires it

This paperwork is the backbone everything else attaches to, so start it early.

2. Understand your health department's requirements

Your local health department is the most important relationship you'll build. Requirements vary by jurisdiction, but nearly all of them care about the same fundamentals:

  • Adequate refrigeration and safe food-holding temperatures
  • A three-compartment sink for washing, rinsing, and sanitizing
  • A separate hand-washing sink with hot water
  • Smooth, cleanable, non-porous surfaces (commercial stainless)
  • A commissary agreement in many areas (a licensed base kitchen)

3. Pass your fire and suppression inspection

If you cook with grease or open flame, the fire marshal will want to see a properly sized hood, exhaust, and an automatic fire-suppression system, plus accessible extinguishers. Propane systems get their own scrutiny: secure mounting, leak testing, and proper ventilation. We engineer ventilation balance and suppression into the build so this inspection is a formality, not a surprise.

4. Pass electrical and plumbing inspections

Inspectors check that your electrical system is correctly rated and grounded, that your generator or shore-power setup is safe, and that fresh-water and gray-water tanks are properly sized and plumbed. Gray-water tanks generally must be larger than fresh-water tanks. Build quality matters enormously here. Clean, code-compliant manufacturing is what gets you through on the first try.

5. Handle vehicle registration and licensing

Depending on the size and weight of your unit, you may need specific vehicle registration, commercial plates, or a particular driver's license class. 6. Get insured

You'll typically need general liability coverage, commercial auto coverage, and possibly workers' compensation if you have employees. Many events and property owners won't let you operate without proof of insurance, so line this up before your first booking.
